Agree, the stock is acting like a turnaround child.

DAVID,

According to Vivus, we should be hearing a nice string of positive announcements during the rest of this quarter. The shorts can't afford to give up otherwise they are going to lose a lot of money. BTW the money they made was selling OUR stock(not their own shares) so sooner or later they will have to pay the piper.

Following this weeks news IMO we have a clean bill of health to move forward. There is a lot of things on the R&D front for Vivus to talk about. I think the most important subject along those lines is the female SD product. Also we don't really know what is going on on the domestic partnership front. A domestic partnering announcement would certainly propel Vivus into double digits.

I have been hearing(for months) persistent rumors concerning a drug company that has been interested in buying out Vivus but would not consider such a deal until the lawsuit issue was resolved. No company in their right mind would touch Vivus while a liability issue was unresolved. With the nuisance lawsuit out of the way, perhaps there may be a buy out sooner than later and the domestic partnering stuff won't really matter. As far as a buy out price goes, I have been hearing about a stock swap which would value Vivus in the upper teens. I doubt any such deal would occur until Vivus can at least trade over 10 on the open market. The shorts won't give up easily but when they do we will easily move into double digits again.
