Nope, house rule. I pretty sure all listed stocks are marginable, and the Nasdaq is at 4 1/16. I also think that's an exchange rule. I think the Fed only says up or down, but marginability is not required for shorting, except by house rules. I also seem to recall a proposed rule change to make all Nadaq stocks marginable, but haven't heard whether that passed or not.

If you go through Pershing you can. You just have to secure it 100%. DLJ or Yamner both use Pershing.

One of my better shorts in 1998 was KRY from 1 1/16 to 7/16 after they lost their court case. But that was before Datek got all anal retentive about shorting.
