I would like to know what constitutes "silent contempt".

Sticking out tongue. Giving middle finger salute. You need more?

Sometimes staring right through somebody who is talking to you can be a very contemptous act.

Legally, if a judge orders me to tell him what my client said, and I stand silent, I am in contempt even though I have said nothing. Silent contempt.

Beats me! Kings, judges, special prosecutors, officers and teachers are very good at telling what people are thinking, and as Blue has pointed out, only speech not action is protected. Who can refute a sneer? This guy, Private M------ USMC was sentenced to the Philadelphia Brig for silent contempt in 1958. All of the brig guards broke up at the charges (we had guys imprisoned for really serious crimes like transvestism, adultery and shagging the Captain's daughter.) They had him stand with his mattress pad and blankets and all his crap weighing down his arms while they teased him -- "Show us some silent contempt!" He did a lousy job. Just looked very young and scared. So they beat him up with ax handles. I never found out what silent contempt looks like. I'm sure the imprisonment did him worlds of good.

As Chris said, flipping the bird, sticking out the tongue, also Italian hand gestures (stroking the face, clasping left biceps with the right palm), rolling the eyes, shaking the head as in disbelief, shrugging the shoulders and throwing out one's arms as if appealing to a higher power. Folding one's arms and shaking one's head while making a look of disgust. Sticking one's finger down the throat as if retching. Twirling one's fingers round and round at the temple ("he's crazy"). A "Seig Heil" salute. Turning around and sticking out your butt. Mooning. Pointing and acting as if one were laughing.
Pinching one's nose as if one smelled something disgusting. Or even just a cold and angry glare.
