At least in Washington, though, if you foreclose there's a year period to buy back the property. So if you're buying a house to live in, it can be a hassle if they buy back on day 364 and you have to move out.

Depends on the terms of the auction. Could be the sellers pay or the buyers pay. The range is 3 to 10%. If you were near the house with an agent they have a claim. You're a lawyer, work it out but don't bill yourself at your usual rate.

My parents were being shown homes by an agent and didn't buy any that he showed them. They did buy one from a builder in the same neighborhood. The agent sued and collected because they might have seen the construction from the car.
