I've said this more prosaicly in these posts today, but how about:
Were the lie a gun, I'd agree that Bill shot it. The shooting is still determined to be a crime only provisionally. He can still put in his claim of self-defense / whatnot. It may yet turn out to be murder. Facts are such switch hitters, till the final play is played.
