Yes. It may (and probably would) apply to anyone. It all depends on the model (common carrier, etc...) the gov uses to look at the space.

You are right. If cable lines are opened, it will be to several companies. I am sure MSPG, Earthlink, etc will be involved. It has been stated here, and the ATHM thread that there are major technical difficulties to opening these cable wires. From what I have read, it will take years to upgrade the lines and the ISP's technical capabilities to pump info over cable. The important thing, for this thread, is that Aol will be involved. By then, I think the impact of cable will be far less than it is today.
