I think we already had a consensus that driving under the influence is an unacceptable threat and should be against the law because it violates the rights of others.

Also, please realize there is no accurate test to prove whether or not the fellow was under the influence at the time of the crash. It seems to me that his low blood pressure could be as likely the culprit.
