Intel Investors - Intel FINALLY WINS a COURT CASE !

05/17 3:03P (DJ) High Court Dismisses EMI's Patent Infringement Claim Against Intel

Story 0946 (U.EMI, INTC-D, INTC, EMI-BE, EMI-FF, EMI-LN, EMI-MU, EMI-ST...) WASHINGTON -(Dow Jones)- The Supreme Court Monday declined to hear an appeal by EMI Group North America Inc., which said a lower court erred when it dismissed patent-infringement claims against Intel Corp. The justices, without comment, let stand a unanimous ruling by a three-judge panel of the U.S. Court of Appeals for the Federal Circuit, which threw out EMI's lawsuit in September.

EMI accused the Santa Clara, Calif., chip maker (INTC) of patent-infringement in a 1995 suit filed in federal district court in Wilmington, Del. The company, part of London's EMI Group PLC, didn't specify the amount of damages it was seeking. EMI's claims centered on Intel's process for making semiconductor gates, which are used to connect transistors in chips. EMI said the Intel method was so similar to its own patented process that it amounted to infringement. The district court, after a hearing, dismissed the claims. The ruling was later upheld by the Federal Circuit. Scott Ritter, 202 862-6687; scott.ritter@dowjones.com Copyright (c) 1999 Dow Jones & Company, Inc. All Rights Reserved.
