The following is a purely fictional account with no intention to be based on much of anything: SCENARIO: Committee hearings involving a securities policing agency known as CES. Committee Chair: Mr Jones, we understand you are employed by the CES, an agency charged with the mission to police the securities industry to ensure certain standards & reporting requirements are met. Mr Jones: That is essentially correct. Committee Chair: Mr Jones, we understand that you suspended the trading in company XXX due to your agency's concerns about their use of the so-called pooling method in accounting for purchases. At the same time, numerous other companies have utilized the same method w/out incident. Is this accurate? Mr Jones: This could be true. Committee Chair: If true, is there any particular reason you chose to specifically announce a suspension in the trading of company XXX? Mr Jones: Not particularly, no. However, we felt it would send a message to others. We fully intend to go after others such as GE, AOL,& Microsoft in the "near future". Committee Chair: Mr Jones, would it surprise you to learn that we discovered that yourself and some of your apparent "associates" hold short positions in company XXX? For the record, it should be noted that the short position alluded to was well hidden & took considerable digging to discover. Well, Mr Jones. Your response?
