If your broker told you it was too late, they probably hadn't
read that there was an extension again today. Most brokers
should be able to do the tender in 2 days.

As far as the current price of the stock, it is in part a
measure of the risk that the deal will not get done and in
part a risk/return evaluation (if you buy the stock today
at $26, your *maximum* gain will be $3.25 or somewhere on the
order of 15%. However, should the deal not go through, you
could loose as much as $17/share (if the stock dropped down
to the $9 range where it was when the deal was announced).

The big risk factor right now is the DOJ. Once that review
completes, you will seen the stock price move towards the
deal price.
