Firenza, to me the coup d'grace for AOL's attempts to get the FCC to mandate access is contained in the following:

Kennard, in a little noticed but breathtaking remark, suggested that AOL might have to sell a part of itself to the cable companies in order to get favorable access to their high-speed network. Or it could strike some other kind of agreement. That could leave other ISPs out in the cold, but hey, business is business.
