There are all kinds of legal analogies that could be made with regard to the situation in Kosovo. One of the more pertinent is a building of people being held hostage by a group of crooks. If there were well barricaded and heavily armed, you as the SWAT commander have to decide exactly how many losses you will suffer or inflict in effecting a rescue/assault.

There is never a guarantee that hostages won't be accidentally injured or killed in a police action, but when the hostages are being summarily executed one by one, you have to make that tough decision to act.

Instead of going and kicking @ss (if we even have that capability anymore), we are combining negotiations with sniper shots (laser guided bombs are the closest thing to airborne sniping we have), trying to take out the bad guys without hurting the innocents. Sometimes you screw up and an innocent is injured, but to do nothing gurantees that more people will die and you participated in sealing their fates.
