Dear VISXbull, perhaps you weren't speaking directly to me when you wrote this post, but in case this was directed at me, I wanted to make something perfectly clear.

Somebody asked on this thread why the stock was weak and selling off this morning. I responded with the story that I had heard and what I believed the concerns were based on. I also responded that I knew nothing about the merits, and so forth.

So I think you may have misunderstood, and blurred the difference between someone taking a bear position vs. someone who was answering a question (with a position that you found unfavorable). I am neither a bull nor a bear in VISX.

One more thing, as I said previously, VISX warns in their financial report that there "could be material adverse effect" on this ruling - they would NOT say this unless there was a chance (however small) that it was true. They do this so they can say the "warned" the stock holders in the event that this outcome happens. I presume therefore, that this IS a potential outcome as judged by their own attorneys who authored the statement. For you, or any analyst to say that this is not a possible outcome, it seems to me, would be putting yourself in judgement of the merits, and taking a position that VISXs own attorneys won't take.

I currently have no position in VISX, but am interested in starting one. If the FTC ruling will not have a material effect on VISX, then this looks like an excellent buying opportunity. I am wondering if a negative ruling is already reflected in the stock price. If not, how much lower will the stock go upon a negative announcement? I would appreciate any input.
