Well they have assets... they hold shares of CBQI.

Do they have to meet all 3 requirements or just one? At this point, I would think they could be considered, out of business... but they do have assets.

is the company out of business? - Nope.

have they had their corporate charter revoked? - Not to my knowledge.

do they have any assets? - Yes.

But I know several people who, on the advice of their accountants, wrote off Midland last year on the strength of its not trading for an extended period.
