The tentative ruling does not address who retains control of the test suite standards. Say if Microsoft can create a JAVA clone in a "white room", does the judges tentative ruling state that this JAVA clone must pass SUNW's test suite now and in the future? In other words, it is unclear if SUNW retains control of the standards of the language and its clones.

Do you have an interpretation of the judges statement?

I must believe that the judge will side with SUNW on control since he ruled that in his opinion the evidence is compelling that SUNW would prevail.
