Up to 2,000,000 shares of common stock which we will have the right to issue to St. Annes, subject to certain conditions, pursuant to the securities purchase agreement (of this amount, we may sell shares in the future); and Don't like this provision: If the market price is $4.00 or less, then the price for the shares shall be 86% of the market price; and o If the market price is greater than $4.00, then the price shall be 88% of the market price. This sounds rather vague: St. Annes has agreed that it will not engage in short sales of our common stock except during periods of time determined by us when the prohibition on short sales will not apply. Well, when is it?? I don't have much time to look the filing right now, but will this weekend. Comments? x

Rande, looking at today's #'s, you're absolutely right. For example, look at this: NYSE Advancers - 1464 NYSE Decliners - 1607 Nasdaq Advancers - 1829 Nasdaq Decliners - 2100 However the # of upticks on both exchanges was positive by a wide margin. What helped today on the Dow is that the financial issues bounced quite a bit. AXP and C were strong, and of course IBM. Hell, IBM accounted for almost 70 points on the Dow itself. HWP also had a decent day it looks like. Going to scratch my head a little harder now. JR
