Aus, it's really difficult to comment on a lawsuit unless one can actually see the wording of the complaint. It sounds pretty frivolous to me, and if so, SanDisk would be well advised to get the best defense litigator they can find and immediately file a motion to dismiss with prejudice, and ask for court sanctions in the form of reasonable legal fees and compensatory costs under Federal Rule #11 (frivolous lawsuits). I'm not a lawyer, but I have some knowledge here.
