Interesting question and one that needs clarification. I wonder if a music "player" is considered a recording device, although one would think that downloading music is a method of recording voice. Hmm... On another note there has been an update to the EDIG Website. Still lots of room! edig.com Cheers. Bob

I would hypothesize that there is a difference between placing a stream of non-constructed data onto the memory chip (ie. RIO....you have your data stream already created in the form of the pre-recorded MP3 (pre-created bits) on your PC) and taking external source (voice/mic), running it through a process to create the bits (chip that takes the microphone input and creates bits out of it) and then placing those bits on the memory chip. As such, I will further hypothesize the patent is differentiated by the fact it covers data that is created in "real-time" and then moved to memory, rather than data that is simply transferred in a sequential manner (as such, you could transfer the "real-time" block onto a PC, and the transfer back over to the device would no longer be covered). It is the aspect of "voice recording" that I believe makes it different than merely "replaying a voice." In the few patent cases I've read, the differences are almost arcane enough to make ones head spin (or fall asleep). But, I guess that's how the creation process is best served.
