This information was from NASD and T A P recommends you verify all information with your financial advisor and or NASD.

TAP, I suggest you post date and name of person you talked to at NASD.............better yet, post it exactly as they say it !

why.....? I believe this statement is misleading again,

If TNRG is lower it will be next day, and you must be
shareholder of record on that day, so to allow for trade settlement you would need to have owned TNRG 3 days prior, so if you wait till ex-date to be announced to get back in you may miss dividend under this scenario. If TNRG is 25% or greater in share price than TIPS you should have about a weeks notice of ex-dividend date as it will occur day after Pay Date.

IF X DATE IS TOMORROW AND I BUY TODAY.....I GET THE DIVIDEND PERIOD!

that is the reason behind why an Ex Dividend Date......so that BOTH SELLERS and BUYERS play on an even field.
BUYING today includes the dividend....
BUY tomorrow and you dont get any of the dividend and THE PRICE OF TNRG will reflect on it.
All this talk about "3 days prior"...."trade settlement date" is misleading!

But then again........ when we FINALLY get those TIPS shares we can all learn from it whoever comes out RIGHT about all these damn rules!

TAP,
If I get this right, if TNRG's share price is 25% lower than TIPS on the day of SEC approval, we will only have one business day notice of the ex-date. Not only that, we would have to own TNRG 3 days earlier for settlement purposes to receive the dividend. Since we have only a general idea of when the SEC will approve the dividend (August), we must own shares of TNRG by the end of July and hold to have any chance of getting TIPS. Please correct me if I'm not interpreting this right.
