Nasdaq needs an upbid (an upticked, "green" bid, min 1 /16 higher than the previous bid) to allow a short sale.

True, IF you are trying to sell at the bid. But you can always offer the stock for sale above the bid, and if someone is willing to buy it at that higher price you can still short. This does not require the bid to increase. Right?
