Aus and Thread,

A few thoughts on the Lexar lawsuit. (I would have chimed in earlier, but my estimable ISP got screwed up today.)

It is not uncommon for countersuits to be filed in this type of case. Clearly the libel that Lexar mentions must have been in private (still could be libel, of course), because SanDisk has been all but invisible in the media.

Another reason for filing the suit might be that old favorite--delay. If in fact Lexar is gaining market share (just a speculation), then they may want to put off settling these suits until they grab more share. Some of the issues is the old IBM antitrust case became moot, because the case dragged on in the courts for so long.

Finally, they probably believe that they can wangle a better settlement on SanDisk's claim if they have the threat of continuing this suit.

Just my 2 cents.

My favorite line in the Lexar release was the bit about SanDisk being a large, public company. Made us sound like IBM--I like that.

Jim

Ausdauer, having taken the time to examine your posts over time, and to put them all into perspective (comparing past and present), I have come to a few simple conclusions:

1) You are unusually correct in your assessments.

2) You make every possible attempt to explain the reasons and purposes behind your beliefs .. and provide appropriate documentation.

3) You are polite and kind in dealing with those who challenge your beliefs. Even when they challenge the basis of your mindset.

4) See #1 above.
