Jim: **OT** Well, I have never gotten satisfaction with E*Trade, no matter how egregious their fills. Of course, they are now NOT getting thousands of dollars a year from me on commission any more. I have tried hours over days tying to get through to talk to someone.

Most of the time when you call for a broker you get an intercepted answer by someone who can not execute a trade. They always ask, do you want a broker? And, I always say, why the hell did I punch the numbers on the phone for a broker. Then they so OK, I'll get you a broker and I go back on hold, then 10 to 15 minutes later (if I am lucky) someone picks up the phone and it still is not a broker so the process repeats for up to an hour. Of course, I no longer use them, but I do still have a small account with them. I like to know when they are having problems, it has been good for shorting alert….<g>

Anyway, E*Trade never pulled back a trade on me, after a confirmation. If they did...I would sue, period. Of course, getting a confirmation from E*Trade is the problem most of the time. You never know where you stand. Timely E*Trade confirmations are history.

I came to the conclusion they are using the short to their advantage on some trades. If the stock continues down, they say it never filled, but if it comes back up on you they say they filled it. I had one short confirmed an hour after I cancelled it, right after the close. Of course, the confirmation indicated the fill took place shortly after I placed the short, (1 ½ hours earlier) yeah right. The next morning giant gap open. Thanks to Level II, I traded out of that one for a small loss, but I stopped using E*Trade. I demanded E*Trade give me back the small loss in commissions (about $90.00) as a show of good faith. The snot nose little kid I had to deal with, refused. He would only give me back part of one commission. He gave up over a thousand a month in commissions from me over 90 bucks. This shows you how stupid the personnel at E*Trade are...<g>
