Don, I did not say that shorting against the box is impossible, I said that it is no longer possible to use it simply to convert short term gains to long term gains. One way around it is doing the long and shorts in separate accounts, and preferably under different names (two spouses, which of course requires more funds, since the long can no longer be used as a collateral), and yes you are right, if one wants to do shorting against the block, it is best to consult a tax accountant, and a good one, since many CPA are completely lost in the new maze.
