Settlement Q & A

From the IFMX website.

FYI-according to the form at the www.milberg.com site, the eligibility period runs from 4/16/96 to 3/31/97.

Settlement of Class-Action Lawsuits Q and
A

Q. What are the terms of the settlement?
A: The total amount of the settlement is $142 million, consisting of $51
million in cash and $91 million in Informix common stock. Of the $51
million in cash, approximately $34 million will be paid by Ernst & Young,
Informix' former independent accountants, approximately $13.8 million will
by paid by our insurance company and approximately $3.2 million will be
paid by Informix.

We will initially issue 9 million shares, which assumes a value of $10.11
per share. If this value is not achieved during the evaluation period, the
company has the option of paying the difference in cash or stock.

The complete details of the settlement and the evaluation periods will be
outlined in our next Form 10-Q filing with the SEC.

Q. What period does the settlement cover?
A. Milberg Weiss has been appointed as lead plaintiff attorney and can
provide you with details on the class period.

Q. How can I become part of the class and receive a settlement?
A. You can register on Milberg Weiss' web site at www.milberg.com or
call Milberg Weiss at 1-800-449-4900.

Q. When can I expect to receive a settlement?
A. Milberg Weiss, the lead plaintiff's attorneys, will keep you updated on
the status of the settlement.

Q. How can I get more information?
A. For information on the class action or becoming a member of the class,
you can contact Milberg Weiss through their web site at www.milberg.com
or call them at 1-800-449-4900. At the current time, there is no information

to appear by Tuesday, June 1. For further information on Informix, you can

Ramon,
You can hope that someone fat-fingered the date entering this entry. I had seen other information that indicated that the class went back to early 1995. Further, how can the Illustra shares be part of the class if the buying phase starts 4/96, because the Illustra transaction was completed in 2/96 (all stock converted)? Your purchase date indicates that you bought near one of the all-time highs, which occured just a few weeks earlier. The rumors of the evidence (and especially the restatements) indicate that the manipulation was going on well before your purchase. Until the complete settlement report is given, consider all numbers and dates with a grain of salt.

In my case, adding a year to the class would just about double my shares eligible and pick up a bunch of the highest priced shares otherwise not covered.
