RTev: Appeasement and defeatism. It didn't do Neville Chamberlain any good! The government has no case and that is why Jackson didn't want to see the case back in his court. Tell me, did he think MSFT would agree to breaking up the company, did he think they would agree to allow the government to design their software, did he think that MSFT would allow its rivals to win in court what they couldn't do in the marketplace? The Appeals Court will throw out any decision and remedy involving the above points so fast it will make Jackson's head spin.

RTev - agree with you completely. Just look what a "win" did for IBM. It kills the culture. MSFT will be like a beached whale, unable to defend itself, or pursue the prey. Sure, it'll take a long time to die, as there's a lot of fat, but the steady erosion will eventually spell it's demise. It will be nothing but a zombie. Alive and well, and living only in theory. My only hope is that Ballmer, who seems a sharp guy, understands the stakes, and is mindful of history.
