You would more be looking for a statement that says such stocks are not shortable. I am not sure if you would find one.
Usually people confuse marginability with shortability. Shortability has more to do with borrowability, not marginability.

I agree with Steve, there is no exception posted concerning the shortability of any stock other than the uptick rules and borrowing of the stock. At least not that I have found. IPOs, BB stocks if they are borrowable they are shortable. And yes I have done this and know many people who have, all at legitimate brokers. Unfortunately you are in a hyped stock (NCDR) and you get those types of posts. Just take them in stride and remember that you have shorted these stocks as have many of us, so those posters evidently are badly mis-informed (which you will find is a great advantage to you). Actually, I tried to read the rules and regulations on the SEC site but you talk about legalize! They are really hard to follow (but no mention of price is involved), so I just go by what I can actually do now, not what people like these say I can do.
