I presume you are talking about latches.

A Patent Holder cannot sit on a issued patent while the world infringes around you and take no action whatsoever, however, the patent holder only has to show diligence in attempting to enforce their patent. The do not have to show success in enforcement.

The patent holder must notify the infringers and then continue to pursue whatever recourse they feel is available to them.

That holds off the effect of the latches.
