Since shorting is done on margin and is leveraged, it would seem as if the shorts group's broker(s) would have forced a margin call or automatically sold the shorts position at market if they could not meet the call.

What culpability would the broker have if any?

Geez Coz, if those holding phantom unregistered shares are
unprotected in the event that the shorters have no money
or can't be located or even if phanton
shareholders would be involved in lengthy litigation
(sharing what little money could be extracted
with lawyers) you are sending out one hell of a sell signal!!!

I think this issue needs to be addressed further....
