If you can't create value from your online efforts, just the pants off those who do!cnnfn.com Amazon, NYT in legal spat Bookseller wants to use Times' best-seller list despite paper's opposition June 4, 1999: 7:26 a.m. ET NEW YORK (CNNfn) - Amazon.com, saying it faces a legal threat from The New York Times Company, has asked the U.S. District Court in Seattle to allow the online bookseller to continue a promotion based on the Times' best-seller list. The New York Times Company (NYT) last week demanded that Amazon.com cease using the well-known list and stop promoting that Amazon.com sells the books on the list at 50 percent off, Amazon said Friday. In its court filing late Thursday, Amazon.com said it asked for relief that would allow the company to continue using the roster of best sellers. While the online book store did not lay out its copyright case, it said "The New York Times best seller list is widely used in the book-selling industry as an indicator of the most popular books being bought nationwide. Book buyers, therefore, can easily use the list to make price comparisons on the best-selling books." The New York Times, Amazon said, is in a "book-selling business arrangement" with Barnes & Noble, a major competitor who also offers 50 percent off on Times' bestsellers. Amazon.com appeared to relish this copyright tiff with the influential newspaper, mentioning the word "50% off" seven times in its press release. New York Times Company officials were not immediately available for comment. The legal sparring comes nearly a week after a critical article in Barron's called the book seller's stock vastly overvalued. Amazon.com shares Thursday fell 7-1/6 to close at 105-1/16. New York Times Company stock dipped 3 /4 to 33-15/16
