At first glance it looks like you could be right, but the press release is filled with enough mentions of exceptions to the conversion rules that I'd want to look at the relevant SEC filings. This might provide an idea of what modifications were made to the conversion restrictions of the first preferred series, which could be significant, and also what other plays might be possible for the investor to profit from his investment.
