This is similar to "Feature Group D" and "equal access" in my opinion. I do not believe that equal access requires a right to own a piece of the cable but a right to interconnect to the cable with equal access (i.e. just like ATHM). Therefore, whatever is required in Cable land to provision the equivalent to "Feature Group D" for equal access to the ISP MCI's, Sprint's etc will be done. This should not be too difficult as it would require a common Domain Name Server (DNS). But, the real issue is how the Cable operator charges the ISPs for "Feature Group D" access. If its flat rate, then its easy, if its metered, then we have a new ball game. AT&T is still in a good position to really cash in on this turn of events. I mean Hey I did not want to charge metered rates but they made me do it.

Frank, since in my opinion this was inevitable, since the ruling is similar to that which has happened in Canada. Anyway, Shaw or Rogers stated that this is great,since it increases the revenue streams for access to the cable plants. Now, the point is that T is the clear winner in all of this if they proceed on schedule with the rebuilds. I believe they will,and the infrastructure builders,GIC,SFA,NT,ANTC,HLIT will continue to flourish from all areas of cable rebuilds.
Why would T stop the rebuilds? This is one ruling,and either way they win,though ATHM probably loses if this sets a precedent.
