You seem to forget that it is the ATHM network that others can freely ride.
Is that true? Isnt it the AT&T (TCI) network that others would ride bypassing ATHM altogether? Equal access and all.
Obviously only the very big names would have the capability to do that, but I'm sure they would if given the opportunity.
I agree with you that it would likely be in the best interest of AT&T to allow equal access. I dont see how it is clearly in the best interest of @home.

This might be true, but ATHM wants to be the AOL of broadband. T forcing the above on ATHM will take the wind out of their sails. When you get right down to it all that matters now is the fact that Portland's ruling is going to hang over ATHM, so ATHM the stock is junk, and the likes of AOL will benefit.
