frick. I probably agree that it is LEGAL if your position is in margin, and ILLEGAL if your position is in cash. BUT, as to whether or not it comes to question ( cash/short/illegal ) would only arise if the brokerage failed to honor your position in cash account....

My quess is every brokwer can buy and cover without you ever finding out.

At NDB and their SHERWOOD group making the market, do you honestly believe that "in house tallies" of certain staocks are not manipulated to balance a load.......need/no need.?

anyway, the technicality in your question stands and is correct.

frick. I must be wrong? you probably would have to move the cash account position of your own that you want to short over to your margin account in which you would short it.

The law does support the demand in cash account, but i do not believe it is respected ALL the time.
