Yes, that's my point.

The ruling says the Portland court will regulate prices.

There is no way you can say "equal access" and not define, in exact dollars and cents, what the term "equal access" means.

If allowed to stand, every city in the country, at contract time, can do the same. I don't want to guess what The city of Berkeley might decide.

The regulation of price in a nascent market would be a violation of the Telcom Act of '96.
Is not regulating "equality" also regulation of price?
People are never equal, businesses are never equal. Equality is a myth.
