In an investors conference last month Elizabeth Divila, the President, said that it would likely happen either way in response to a question.

The FTC has 10 days to file an appeal Chuzzlewit. We will know soon enough but, in most cases I understand an appeal is filed. Although that is the safest assumption, the language of the administrative judge in his opinion was relatively strong in favor of VISX. If a judicial opinion were to have any influence in any direction, this one surely should dissuade the government from appealing. It was that strong.
