The law, is like the market, one can never be that knowledgeable, and like the market, it keeps changing.
When I posted about "totality," I was referring to the "totality of the facts and the circumstances." That includes demeanor in the court room for the purpose of determining credibility.
However, jurors are not supposed to take someone's race, religion, political thoughts, gender, etc., into consideration in their decisions. However, we are all human, with human failings, and obviously we all have our prejudices.
I don't think you want justice by a dictator or by a computer so it's unlikely that we can get a better system in theory. That being said, I'd do a lot to change the system of justice, as it is slow & inefficient, as is most of government. It has gotten to the point where criminal law is basically, "innocent until proven broke."
Anyway, I respectfully disagree with the implication that the defendants were somehow treated differently by the jury because of their "side of the market." That just doesn't make any sense if you've dealt with juries or trials.
