General answer: In criminal trials, the defendant has far less access to evidence than in a civil trial. The defendant only has a right to exculpatory evidence -- evidence which will tend to prove that he is not guilty.

Specific answer: I don't know. Despite the fact that Moussaoui is representing himself, he still has court-appointed attorneys who are there to protect his rights, and they argue that his rights will be violated. The usual way such things are handled is to give all the evidence to the judge and let the judge decide.

Lawyer's arguments don't necessarily jibe with the facts. For example, Malvo's lawyers were in court Friday arguing that he should be returned to juvenile detention because his mattress was too thin in the adult detention center. On Tuesday they were back in court arguing that it was possible that he might need a mental examination. Both motions denied.
