Yes and no. Enforcement of penalties for violations of the Terms of Use is, by definition, subjective.
Again, I say I don't know what he did, and I don't know him.
I agree completely that the rules have not been enforced in a consistent fashion. I believe that is the underlying motivation behind this whole thread.
I'll just say it again in a different way. I don't run this site. If I DID, then anyone that personally attacked another member would be gone instantly. They call that a "suspension". You get this little note that says "You have been suspended until [three days later].
Anybody that broke the law, or even looked to me like they MIGHT be breaking the law, gets three days to think about it and then they can ask the Cybercop pretty please if they are nice can they come back.
That's a judgement call. That's the Cybercop's call. If I ran the site, I would just let the Cybercop do his job.
If somebody, anybody complained about a Cybercop call, I would just ask the Cybercop "You do the right thing on that?" and if he said "Yes", then the discussion is over.
In the event that something happened where I believed that the Cybercop screwed up, then I would have a discussion with the Cybercop, in private, and sort out the problem. If it involved an error, for example Mr. Mighty Chicken was horribly and unjustly banned from SI, then I would just tell my employee to turn on Mr. Chicken's password and go about his other business. This is not rocket science.
If some member got belligerent or pissy, then I would have some coffee or a snack or a nap or wait three days or whatever, but I would not under any conditions undermine my Cybercop's authority. The Cybercop is either doing his job or he isn't. If he (or she as the case may be) is screwing up on a consistent basis, then I fire him or her.
Otherwise, I back up my employee because I trust him. I hired him and I gave him his job and as long as he does it, then I don't want to hear about whatever crisis just got the Guru's acolytes all dizzy, I just want to hear that it's handled.
If my employee comes to me, I want to hear, "There was a problem and this is what I did to handle it. Have a great day."
I DO NOT want to hear, "Gee boss, what should I do? Ask the members to vote?" I didn't hire the guy to ask me how to do his job, and I wouldn't take his responsibility away from him unless it was real, real serious. And then I would just clear it up, shake his hand and put him back to work.
But if anybody wanted to get pissy with my employees, then I'm sorry, I don't have much sympathy for that. That ain't professional, and that ain't the way I do business.
I back up my employees 100%, or I fire their asses and hire somebody that can do what I tell them.
This presupposes that I can tell a good employee from a useless jerk.
