Another e-mail, from Randy:
Subject: Message from the Chairman Date: Sat, 23 Oct 1999 14:28:24 -0700 From: David Webb <info@bioponic.com> To: info@bioponic.com
This email message is intended to reach all those shareholders and other parties interested in Bioponic International who we believe received an email message on Friday afternoon, October 22, 1999, from an individual identifying himself as "Tom Perk." In that message this individual took it upon himself, without checking with the Company, to "inform the investors of Bioponic that the Company will be filing forms for Chapter 7 bankruptcy this fall." On Saturday, October 23, 1999, "Tom Perk" sent a second email message, purportedly to all those receiving his first email message, retracting the first message with a ridiculous excuse about "hearsay."
There is no excuse whatsoever for this kind of reckless behavior. This is obviously a totally irresponsible, and perhaps malicious, use of the Internet. We are actively seeking to learn the identity of the person responsible for this false message. The Company is determining what further action it will take to protect its rights, and the interests of its stockholders, against "Tom Perk" or any other persons who recklessly or maliciously spread false statements about Bioponic International on the Internet or in other media. Our Counsel has already contacted Yahoo! in an attempt to learn the identity of "Tom Perk." We would appreciate your assistance if you can help us locate this individual.
Bioponic International has no plans whatsoever to file for bankruptcy. To the contrary, our business continues to develop consistent with our business plan and we are working on certain long-term projects which we expect to be able to disclose to the public in the near future. In addition, this past week we completed the planning phase for an expansion of our Parkmont Plant in Butte, Montana. This expansion will eventually enable us to increase our production capability for liquid zinc sulfate to a rate of approximately ten times our current production rate. Also, we continue to work toward completing the legal and accounting efforts necessary to both (i) file our Form 10 with the SEC to become a fully-reporting company, and (ii) effectuate the planned spin-off of the Airponic Growing System subsidiary to all the Company's stockholders.
We will continue to keep you informed as best we can on these and other developments that may affect Bioponic International stockholders.
Sincerely,
Randall S. Reis Chairman & CEO |
