Is this legal?
No. To prevent a wash sale you cannot buy for 30 days before or after the sale.

Since BNEZE is not likely to go any lower you could buy an equal amount and then wait for 30 days and sell. Still have time before the end of the year if you do it now.

Of course losing the spread is no minor detail here.
