This must be the patent referred to by Luxell:

U.S. Patent #5,049,780 issued 09/17/91 to Dobrowolski et al.,
Optical interference, electroluminescent device having low reflectance
patents.ibm.com

The invention was also patented in Canada, Europe, and Japan.

Assignee: National Research Council of Canada

On their page Origin of the "Black Layer", Luxell says:

The patent for developing this optical interference layer was granted to the National Research Council. Luxell holds exclusive worldwide licensing rights to this technology.
