Of course, FACTS should be the ultimate determinant in this regard.

They seem to be hard to come by.

BTW, I differentiate what is happening WRT to a potential court case and what happens in this forum. 2 hugely different venues.

Absolutely , I agree that Tim Luke should have every recourse in defending his position.

And as of yet, I still have no definitive understanding as to what his position is in a legal sense.

And yes, he has no "burden" to "explain himself" regarding his legal case, although he has expended considerable energy on the "forum" side.

As far as any judges dismissal, I based that comment on your description, not Tim Luke's. I'm sure if he gets as far as a courtroom, he'll have a clearly defined case.

At least I hope so...if not, let's further hope his attorney is on a contingency basis.
