I think this is going to be one hell of a ruling. One of my favorite areas of study in college was Philosophy of Law. Interesting problems.

My opinion is that the state does NOT have a compelling interest to advance "diversity." The compelling interest, IMO, is the advancement of education to those most deserving by merit, and assisting those who are most deserving but least advantaged. College applications should be like job applications - race neutral by law. Admittance to university should be decided on the merit of past study and activities that demonstrate leadership and responsibility. Financial aid should remain income dependent. Those students that can not "make the grade" for direct admittance can do what they already do - go to community colleges and transfer once they have demonstrated merit. College is for educating, not social engineering.
