Two problems with that argument:

(1) The possibility that your crime may have prevented future deaths does not change the fact that what you did was a crime - in this case, extermination of a civilian population.

Consider the hypothetical case of the time traveller, who, knowing that Bush will lead to the death of 10,000 Iraqi civilians, kills him and his entire (proposed) administration prior to the election.

Is what he did a crime or not, since by killing Bush et al, he will have prevented more than 10,000 deaths?

(2) If the war was to continue, the deaths in question would be among soldiers. US nuked two civilian populations.

In fact, you and I had come to an agreement back in 2002 that the nuking of Hiroshima and Nagasaki and the extermination of their civilian populations were not "war crimes" (because of the wording - "in territories under occupation") but very likely were "crimes against humanity".
