If you ask PBG mgmt, they'll say THAI uses existing technology: vert well, horiz well, and insit combustion. The only thing that is unique about THAI is the how these technologies are used to develop a new configuration. Since the THAI configuration is different the method for controlling the fire front, establishing the contact between the vert and horizontal well, and creating the negative pressure zone will all be used uniquely within the THAI configuration of the technologies, hence their patentability.

If you read the patents then you'll notice they always refer to the specific technology and how that piece of technology is being used in their process for example, place the horizontal well relatively low in the reservoir. place the veritcal well relatively high in the reservoir.

Lastly you'll notice that insitu patents are quite common and were developed in the 70's , 80's, and 90's. Now look at the date of THAI's patents they are relatively new compared to the other patents. So the THAI patent must have been found to be unique even in the face of all the prior insitu patents or else THAI would not be granted a patent.
