But the idea that a service provider actually would license the Broadcom patents never crossed my mind.

Is there a bright side here? Well, this VZ-BRCM license agreement certainly highlights the argument that the downstream parties were the ones harmed, the same downstream parties that Broadcom chose not to charge with infringement before the ITC.
