JLA, Foster was never the target of the criminal investigation, had he lived, he would have been called as a witness, like Bruce Lindsey. The courts had already ruled that there was no attorney/client relationship between Hillary and "her" government attorneys. We are traveling down this road again with Bill Clinton and his assertion of attorney/client privilege with Lindsey. Starr is trying to get at information Foster gave to his attorney as it relates to the investigation of Hillary (travelgate). Foster would have been called to testify had he lived, the information that the Grand Jury is seeking would have come from him directly, since he is now dead, the next best source would be to whomever Foster disclosed, this person just happens to be his attorney.
