Someone please correct me if I'm wrong, but wasn't it AOL that asked for a summary judgement? In other words, they asked for it thinking the judge would easily or quickly award it as AOL felt the CDA would "protect" them. ? The fact that the judge said "no" right now to AOL's request and awarded the limited discovery to BNEZ says he thinks there is more it (being a content provider) than that with AOL in this case. Sounds to me like BNEZ's lawyers showed enough about how AOL "shows" or relays quotes to warrant the discovery. So I do not get the impression at all that the judge "does not think that BNEZ has a case". Seems he thinks there may be more it and is allowing the discovery to determine that.
