I think the point Terry T was making was that when what someone hears is something different from what someone says (misunderstanding, misinterpretation, whatever), the breakdown in communication does not constitute a lie. A lie is when what you hear is exactly what the communicator intended for you to hear, and is a known untruth to the communicator. Can you honestly say that is 100% the case here? I do not know.
