First, you want the company to do something that is not legally "due", and, from what I understand, would be ultra vires if they did. Nonsense. There is nothing ultra vires about reporting prior quarter financial condition. That is not beyond the scope of what they can do. It is only beyond the scope of what they want to do. Unless of course they have no prior quarter, as the merger is still not complete. Are you going to embarrass yourself further with your shallow understanding of the law, Mr. Qui Tam? Or are you reporting that the merger is incomplete still?
